1. Contract of Hire 

All rental bookings for Villa La Pagerie, located in Carriacou, Grenada, West Indies, are subject to the acceptance in full by the hirer and all persons in their party (hitherto referred to as “Renting Party”) of these Terms and Conditions established by West Indies Sunrise Estates (WISE) Ltd. (hitherto referred to as “Owner”). Bookings are accepted and confirmed once payment is received by the Owner. 

2. Confirmation of Booking 

Bookings are provisionally held for the Renting Party for seven days from the booking date until full payment is received, whichever is sooner. Bookings are confirmed following receipt of rental payment.  Accommodation is paid for in full in advance.  For stays of up to 1 month, the amount payable is due in full.  For stays longer than 1 month, payments can be made in installments.  Confirmation will be sent to the Renting Party by email stating the date that the security deposit hold is to be paid. 

3. Payment Requirements

Payment can be made by direct deposit.  Payment of the rental fee and the security deposit hold must be received in full prior to the check-in date or access to the villa may not be provided.  All transactions are processed in US dollars $USD.

The Renting Party is responsible for covering any associated bank charges charged by either the Payee or the Beneficiary bank when making payment or receiving a cancellation refund.

4. Security Deposit

A security deposit is mandatory for all bookings. The Renting Party will authorize a credit card hold for USD $750 before arrival. The hold will be cancelled within 48 hours after check-out if the property is left undamaged and in a reasonably clean and fair condition. In the event that any part of the property is damaged, lost or any breakages occur during the rental period, the costs will be deducted from this security deposit. This excludes normal and acceptable wear and tear. Such damage must be immediately reported to WISE Ltd or its representative. The condition of the property will be judged at the sole discretion of the Owner or the Villa Manager. If damages were to exceed the amount of the security deposit, the Renting Party will be held liable for the remaining damages and must compensate the Owner the difference in cost as soon as possible.

Artwork

The Rental Party must be aware that Villa La Pagerie contains valuable contemporary and antique pieces of art, and must take care to avoid causing any damage to them. Any artwork or antiques damaged during the rental period will be the responsibility of the Renting Party and the costs set off against the aforementioned security deposit.

5. Booking Amendments

The Owner requires a minimum of 14 days written notice for any amendments after a booking is confirmed.

6. Refund and Cancellation Policy

Should the Renting Party need to cancel the villa booking, the Owner must be notified in writing (email acceptable). The cancellation will take effect from the day the written confirmation is received. Cancellation fees are as per the following schedule, plus a US$250 administration fee per booking:

Cancellation Rates & Periods:

  • Over 120 days before arrival date – full refund
  • 60-120 days before arrival date – 75% refund
  • 30-60 days before arrival date – 50% refund
  • 14-30 days before arrival date – 25% refund
  • 0-14 days before arrival date – no refund

7. Alterations and Cancellation by Villa Owner

If, for any reason beyond their control,  the Owner is not able to honor the Renting Party’s reservation, the Owner shall reserve the right to cancel the reservation.For example, but not inclusive, if the property is damaged or rendered unusable, the Owner will endeavor to find an alternative villa of comparable price and standard.  The Owner will describe the alternate premises and location to the best of their ability and in good faith.  No responsibility or refunds for alleged misrepresentation can be accepted. The Owner will contact the Renting Party and request authorization to proceed with this new booking.  If the Renting Party declines the alternative, a full refund will be granted to the Renting Party with the Owner covering any relevant bank charges. Any refund is restricted to the villa rental costs and the Owner is not liable for any cancellation or administration charges for travel arrangements, etc. 

8. Minimum Stay Requirements

There is a minimum 4-night stay requirement for most of the year. During peak holiday seasons (Christmas/New Year & Easter), the minimum stay is 7 nights.

9. Arrival /Departure

The designated check-in time is 12:00, with a check-out time of 14:00, unless alternative arrangements have been agreed upon with the Owner. Any early arrivals or late departure times are subject to the availability of the villa, and will impose extra fees.

The Owner will send detailed instructions for key collection and directions to the villa two weeks prior to the rental start date, together with the contact details of of the Villa Manager, who will be available for the Renting Party on a 24-hour hotline should any issue arise. The Renting Party is entitled to one set of keys for access.

10. Occupancy

Villa La Pagerie is fit for a maximal occupancy of twelve (12) persons. For groups over eight guests, a US$32 surcharge is applicable per person per night. Only the specified number of persons listed in the Rental Agreement at the time of booking may reside on the premises. The number of registered guests given at the time of the booking is the maximum number of persons allowed. If the Owner or Villa Manager discovers that an additional number of guests are staying at the property, it is the absolute discretion of the Owner or Villa Manager to ask the extra person or persons to vacate the premises. Otherwise, each additional person will be charged a penalty rate of US$300 per night.

The Renting Party cannot re-let or sublet Villa La Pagerie to any other group/party or individual without the written approval of the Owner. 

No party, public or private, may be arranged and held at Villa La Pagerie. It is for the strict usage of the individuals who have been notified as established above.

11. Guest Insurance

The villa rental cost does not include any personal insurance coverage of any kind. It is advisable that the Renting Party have both liability and comprehensive travel insurance that provides coverage including, but not limited to, cancellation, loss and damage to baggage and other property, and flight delays. Guests should also carry health coverage that includes, but is not limited to evacuation and repatriation. The Owner is not responsible to the Renting Party for any and all claims including any accidents related to the use of the property facilities or locally procured third party services such as, watercraft, water sports, jeep or motorbike rental etc.

12. Owner Insurance

The Renting Party must not do, or allow anything to be done, that may cause the villa’s insurance against loss or damage by fire to become void or cause insurance premiums to be raised. 

13. Due Care And Supervision/Indemnity

It is understood that the Renting Party is responsible and liable for the safety and well being of guests and third parties while staying at the villa. Both the Renting Party and guests are required to take due care during their stay and take precautions such as supervision of children in the gardens and near or in the pool or ocean. All children must be under the direct supervision of an adult at all times. Damages or injuries suffered by any member of the Rental Party during the booking period or thereafter are the responsibility of the Renting Party. The Renting Party indemnifies and holds the Owner harmless and free of liability resulting from such claims that result as consequences of accidents leading to injury or loss of life.

14. Force Majeure

The Owner cannot accept any liability or pay any compensation in such an unlikely event that the expected level of performance for our contractual obligations is prevented or affected by ‘force majeure’. In the event of incidents such as war, threat of war, civil commotion or strife, hostilities, strikes or other industrial disputes, natural disasters, fire, acts of God, terrorist activities, quarantine, epidemics, weather conditions, government action or other events outside of the Owner’s control, the Owner will not be held responsible for any delay, inconvenience, or expenses caused as a result.

15. Construction 

In the unlikely event that local authorities, private developers or neighbors arrange construction works near the villa, the Owners cannot be made responsible for any annoyance such works may cause that might affect the Rental Party’s stay. The Owners will do everything they can in such a case to limit the annoyance as feasible. 

16. Complaints

Any problems or complaints that occur during the rental period should first be discussed with the Villa Manager. If they are unable to quickly resolve the issue, the Owner will rectify the situation to the best of their ability. The Owner is not responsible for issues such as interruptions to water supply, electricity, Internet connection, cable TV, or breakdowns of pool filtration systems. The Owners will do everything within reasonable expectation to avoid complaints in the first place. The Rental Party understands that when staying in a less developed remote location, that infrastructure, local standards, and conditions may be less developed than in urban environments.

Any complaints should be written and given to the Villa Manager or Owner within 24 hours of the time the issue occurred. Neither the Owner nor their representatives shall have any liability for any complaint submitted more than 24 hours after arrival or materialization, or after the completion of the hire period. Subjective opinions are not considered as a complaint. When the Rental Party chooses to leave a rental over a subjective issue, they do so taking responsibility for such a decision and no refund may be considered in this situation. 

14. Rights of Access 

WISE Ltd, their representatives or their sub-contractors have the right of access to the villa at any time with due regard to the convenience of the hirer for the purpose of linen changes, inspection of the property and to carry out any essential or routine repair or maintenance work in the villa or in the garden. 

15. Social Corporate Responsibility

Bringing any illegal substances into the villa is prohibited, along with the use or consumption of any illegal substances. Unlawful behavior is also prohibited. The Police will be immediately contacted if there is any violation.

16. Conduct Behavior

When renting the villa, the Renting Party maintains responsibility for the appropriate behavior of the guests. If any guest behaves in an inappropriate manner, the Owner or their representative, at their absolute discretion, may ask the offending party to leave the premises. In this case, no refund may be claimed by the Renting Party.

17. What is Included 

The villa rental includes one housekeeping visit every seven days (at a time convenient to the Rental Party), electricity, gas, swimming pool and garden maintenance.

Potable water is supplied to guests during their stay using a refrigerated water fountain with 5-gallon water drums. The Rental Party receives two drums per week. Additional drums can be purchased in town.

Garbage removal is every Tuesday and Thursday.

Utility costs are included with the rent. Windows must be closed while air-conditioning is in use. Villa La Pagerie abides by an eco-friendly policy – we request that all air-conditioning, lights and fans be switched off when you need to go out or stay long outside of the villa. 

18. What is Not Included 

The villa rental prices do not include personal, travel and cancellation insurance, travel, transportation, airport transfers or any additional housekeeping requirements. Catering or supplying a cook are not included, although we may assist in arranging these services externally. There is no air conditioning at Villa La Pagerie (except in one bedroom) but fans are available in each room. Fans must not be left in use when guests are outside the villa. The use of a car is not included, but highly recommended due to the remote location of the villa.

19. Guest Responsibilities

It is the responsibility of every guest to read and abide by these Terms and Conditions and the following House Rules:

  1. Smoking is not permitted anywhere inside the villa.
  2. Pets are not permitted on the property unless specifically approved by the homeowner in writing. Guests are responsible for cleaning up after their approved pet and ensuring that it does not go on the furniture.
  3. The use of candles or mosquito coils in the house is not permitted except for tea lights in tea light holders as the wind is always blowing through the villa which makes an open flame too dangerous.
  4. Guests are responsible for closing and locking all the doors and windows when leaving the villa and at night.
  5. Guests are responsible to inform the villa manager right away if they suspect something in the villa is not working properly or if anything gets lost or damaged during their stay.
  6. All guests using Villa La Pagerie boats must sign a waiver in advance.
  7. Noise levels must be kept at a reasonable minimum, particularly between 20:00 and 8:00 to allow neighbors a peaceful night’s sleep.
  8. If any neighboring residents report excessive noise or unruly behavior, the owners have the right to evict the Renting Party and terminate the vacation rental agreement. This could result in loss of security deposit and rental amount.
  9. Guests are allowed a maximum of 4 visitors at a time during the day during their stay. Visitors must vacate the villa by 23:00.
  10. Guests are responsible for ensuring that any visitors comply with these House Rules.
  11. Parties and large gatherings of any kind are strictly prohibited at Villa La Pagerie to respect the quiet seclusion of the neighbourhood and adjacent Nature Park.
  12. In case of any disputes or neighbor complaints, it is the guests’ duty to notify the Owner as soon as reasonably practicable.
  13. Guests are expected to keep the property at an acceptable level of cleanliness that would be considered acceptable to an average person.  Any unacceptable damage resulting from poor cleanliness will be charged to the guest.
  14. Guests should refrain from moving furniture around. Interior furnishings must remain inside the villa, and only designated outdoor furniture (including pillows) can be used on the exterior.

20. Accuracy of Information 

The owners take a great deal of care to make sure that the information and photography contained in villalapagerie.com is correct and reflects reality. However, changes may be made from time to time at Villa La Pagerie, such as changes to decoration, furniture and fittings. 

All information supplied by the Owners is given in good faith and is based upon information available at the time. All reasonable measures have been taken to ensure accuracy, but the Owners and their representatives are not liable for any variation however caused.

21. Law and Jurisdiction 

This rental agreement is contracted between the Owner (WISE Ltd) and the Renting Party. Any disputes arising from the rental of the property will be resolved between these two parties. 

Any contract that is made will be with the acceptance by both parties of these terms and conditions, which are governed by the the laws of Grenada and both parties will submit to the exclusive jurisdiction of the courts of Grenada.
